Look out!

Duh! They were selling modded Xboxes WITH games already copied on to them. That is pretty dumb.

I call bullshit on that charge...

If you read carefully, they weren't actually selling systems with preloaded games... they were only displaying systems in the store with games on them: "The modified consoles, some holding 15 or more games already copied to the hard drive, were on open display in the stores."

The actual consoles for sale were simply modified boxes with 3rd party dashes. The charges are totally bullshit because what is illegal about owning a piece of hardware (modifiying it), or software that you'd rather use conveniently on a hard drive as opposed to on a disc? The media industry has its head so far up the governments ass, that you don't actually own the media or hardware you purchase.

When you buy a car and modify it with aftermarket parts, noone comes and arrests you for it. When you buy a book, there are no laws against photocopying pages to carry around with you instead of carrying the whole book...

If you could photocopy the entire book in seconds, and then maybe started handing copies to your friends. Then, I'm sure somebody would be interested.

If the xbox has a bios other than Linux, it is deemed illegal, and therefore could lawfully be raided, imo.

If they weren't stealing boxes with games preloaded than they weren't total idiots. But hacked bioses and dvd-ripping sw is bad news. It could turn out the govt has little case in court, but the main idea is to scare people out of getting the idea. That is fine with me, to tell you the truth. $500 is a shit load of money to spend on a "super xbox." If you can't figure out how to do it yourself or get one of your buddies to do it, then maybe you should just buy the games. These guys were trying to make money on a general public scale off the innovations of a very dedicated community that has no intentions on profit. That doesn't mean they should go to jail, but the less of that going on the better it is for the scene.

According to BoingBoing readers they were selling the modded boxes with games. That is good for no one but the jerks that are selling them. Enjoying a game for free is one thing, but when you are making money off of it... that is where I draw the line.
